Your rights may be affected by a proposed class action settlement of claims against Capri Training Centers, Inc. d/b/a Capri Institute and Anne E. Muenster (collectively referred to as “Defendants”). The Settlement would resolve a lawsuit in which Plaintiff asserts various claims against Defendants involving the fees charged to customers for senior student-provided hair and cosmetology services at the four school salon clinics operated by Capri Institute Beauty Schools in New Jersey. Specifically, Plaintiff alleges that Defendants charged fees for hair and cosmetology services at the school clinics that exceeded the cost of materials used in the performance of those services, in violation of a New Jersey statute. Plaintiff brought a lawsuit on her own behalf and on behalf of all people who paid a fee for student-provided services at one of these school salon clinics in New Jersey between February 18, 2010 and April 26, 2019. The Defendants operate four beauty school student salon clinics in New Jersey under the name "Capri Institute" located at 1595 Main Avenue, Clifton, NJ 07011; 660 N. Michigan Avenue, Kenilworth, NJ 07033; 615 Winters Avenue, Paramus, NJ 07652; and 268 Brick Boulevard, Brick, NJ 08723. Defendants vehemently deny the allegations in the lawsuit in their entirety but have agreed to settle the case to avoid the costs of litigation.
The Settlement provides eligible Settlement Class Members with the opportunity to receive two five (5) dollar Service Vouchers (with a total value of $10.00), which may be used to pay for future services at any of the four Capri Institute Beauty School Clinics in New Jersey. Service Vouchers are not transferable to other persons and are not redeemable for cash and may not be used for purchase of products or goods. To receive Service Vouchers, you must timely complete and submit a Proof of Claim and forward it to the Settlement Administrator by either fax or e-mail no later than July 25, 2019, or by mail postmarked no later than July 25, 2019. If you do not wish to be a part of the Settlement, you may exclude yourself. If you do not exclude yourself, you will be bound by the Settlement and all Orders of the Court. As a result, you will no longer be able to sue or continue to sue the Defendants about the claims covered by the Settlement. To request exclusion, you must mail your request in writing, postmarked no later than August 6, 2019, to the Settlement Administrator at Capri Institute Settlement–Exclusions, c/o JND Legal Administration, PO Box 91062, Seattle, WA 98111-9162. The Court, located at Essex County Courthouse, Newark, NJ, 07101, Courtroom 302, will conduct a hearing on whether to approve the Settlement on August 26, 2019 at 10:00 AM, and, if approved, to determine what amount of fees and expenses should be awarded to Class Counsel and the Class Representative. If you do not exclude yourself, you or your own lawyer may ask to appear and speak at the hearing at your own cost. You may object to the Settlement by mailing a written objection, postmarked no later than August 6, 2019, to the Settlement Administrator at Capri Institute Settlement, c/o JND Legal Administration, PO Box 91062, Seattle, WA 98111-9162, saying that you object to the terms of the Settlement in Rosemary Stanley v. Capri Training Center, Inc. d/b/a Capri Institute, et al., Superior Court of New Jersey, Essex County, Docket No. Docket No. ESX-L-1182-16 and give the reasons why you think the Court should not approve it.
